Hey Mr. Obama: You’re President, not King
By Ross Edward Puskar, Author of Founding Fathers Know Best
We are a nation of laws. We have various law enforcement organizations to see that laws are obeyed. We require these officers of the law to swear an oath. On occasion, the President issues an Executive Order that contradicts the law. That act can cause a conundrum for law enforcement officers. Then things have to be settled in our courts.
Step One: About three months ago, sort of out-of-the-blue, President Obama announced his own version of the Dream Act. He was pandering for Hispanic votes. By executive fiat, certain young illegal immigrants would no longer be deported when apprehended. If these illegal immigrants were under 30 years of age and met some other specific criteria, they would not only, not be deported – they’d be awarded work visas. Experts predict as many as 1.7 million illegal immigrants could qualify for this backdoor amnesty.
Step Two: Persons who enter the United States of America without proper passports, visas and other papers – people who unlawfully enter this country – are considered illegal immigrants. They have broken our laws with their illicit entry into America. They are criminals.
We can argue the finer points of the law and how to amend it, and almost everyone agrees we should do just that. But for now, we cannot argue the clear, unambiguous nature of the current legal language. Illegal immigrants are criminals.
Step Three: Presidential decrees, Executive Orders and fiats from the Oval Office do not and cannot change the law. They have no priority over laws. They have no precedent or standing in our legal system. Only Congress can make laws.
Step Four: The U.S. ICE (Immigration and Customs Enforcement) has an annual budget of almost $6 billion with more than 20,000 employees. Their mission: “Promote homeland security and public safety through the criminal and civil enforcement of federal laws governing border control…” More than 8,500 Special Agents for ICE have vowed before witnesses to defend the Constitution and to enforce the laws of the land. Before God and country, they each swore an oath.
Step Five: Secretary of the Department of Homeland Security Janet Napolitano has already warned ICE agents they will be disciplined if they continue to enforce the law and arrest certain illegal immigrants. ICE Agents say they are being ordered by Napolitano to break the law, and to violate their sacred oaths. Political agents have created an untenable position for ICE Agents.
I want to be reasonable here and now, but by golly, I think those ICE agents have a fairly solid argument. They’re between a rock and hard place with no way out – except through the courts.
Step Six: The ICE Agents have asked the courts for some direction. They sued ICE, Homeland Security, Napolitano and others.
Step Seven: As usual, President Obama who started this whole thing has had no comment. He flaunts the law, puts young illegal immigrants in very precarious positions, creates havoc for 8,500 ICE Agents, throws his mess into the judicial system, and embarrasses the country. Then Obama fades into the political woodwork without a word.
Someone needs to remind him. First, Congress makes the laws. Second, you’re the President, not a King.
